What is Training Visa (Subclass 407)

The Training Visa (Subclass 407) allows employers to facilitate workplace-based occupational training activities for their foreign employees, aimed at improving skills relevant to their job, area of tertiary study, field of expertise, or participation in a professional development training program in Australia.

Occupational training types

The Training Visa is divided into three streams of occupational training:

  • Occupational training required for registration: for individuals who need registration, membership, or licensing to practice in their occupation in Australia or in their home country. It ensures that the individual meets the professional standards and regulatory requirements necessary for their occupation.
  • Occupational training to improve skills in an eligible occupation: for individuals aiming to enhance their skills in their occupation listed on the relevant skilled Occupation List. It requires recent relevant experience, equivalent to 12 months of full-time work within the last 24 months.
  • Occupational training for capacity building overseas: this training category is divided into three subtypes:
    • Overseas qualification: up to six months of structured workplace-based training in Australia for foreign students needing practical experience to get their qualification.
    • Government support: training supported by government agencies in Australia or the trainee’s home country, tailored to the trainee’s needs.
    • Professional development: classroom-based programs in Australia for overseas employers to develop their managerial or professional employees.

Eligibility Criteria:
  • Sponsorship: employers must be approved as a Temporary Activities Sponsor. Sponsors can be organisations lawfully operating in Australia, government agencies, or foreign government agencies.
    Good corporate citizen: employers must have no adverse information known to immigration authorities.
  • Genuine need: employers must demonstrate a genuine need for the training position, showing that the training is essential for the nominee to acquire specific skills or meet occupational registration requirements.
  • Active business operations: the sponsoring business or organisation must be actively operating in Australia.
  • Financial viability: the business sponsor must be financially viable to support the training program and the salary of the nominee if applicable.
  • Training plan: sponsors must provide a structured training plan that outlines the objectives, duration, and expected outcomes at the end of the training program.

Employees

Eligibility Criteria:
  • Skills and qualifications: applicants must have the necessary skills and qualifications for the training program, including at least 12 months of full-time relevant experience in the last two years.
  • English proficiency: employees must meet the English language requirements unless exempt. This typically means having functional English.
  • Health and character: applicants and their family members must meet health and character requirements. This includes undergoing health examinations and providing police certificates to demonstrate good character.
  • Family members: spouses/partners and dependent children can be included in the application but must meet their own specific criteria.
  • Age requirement: primary applicants must be 18 years or older.

How to Apply for an Training Visa

3 Types of Applications

Sponsorship application

the employer applies to become an approved Temporary Activities Sponsor. This involves demonstrating that the employer is a legitimate business or organisation operating lawfully in Australia and that the employer meets specific sponsorship obligations.

Nomination application

The employer submits a Nomination application for the specific training position. This application details the training program, skills gap analysis, duration, expected outcomes and how it will benefit the nominee. The nomination must also specify which type of occupational training the nominee will undertake and demonstrate that the nominee meets the eligibility criteria for that particular type of training.

Visa Application

The nominee submits a visa application. The criteria set out above must be met at the time of application, except for health and character checks.
